And/or he/she or they, are taken as interchangeable and thus as referring to the same.

Unless otherwise stated, Hatul Madan and/or its licensors own the intellectual property rights for all the content on https://hatul-madan.org/, as well as all the materials and information sent through other communication means (email, live chat, etc.). With us, all your intellectual property rights are reserved. You may all the above-mentioned materials from Hatul Madan for your personal use, subject to the restrictions set in these Terms of Use.

Upon the creation of your Hatul Madan account, and subsequently using certain features, you should provide us with valid and complete information. 1. Paid Services

Hatul Madan offers paid donations for a fee indicated on the Prices page of this website. Unless provided to the contrary, all prices are quoted in the UAH. Each user shall be responsible for paying the fees charged by Hatul Madan, including the applicable taxes, in a timely manner and in full extent. The available payment methods are listed in the Order Form of this website.

1. Payments and Refund of Donations

Hatul Madan offers monthly guardianship of animals. They entitle the payer of a monthly charitable contribution to access the services of this animal until the moment of its transfer to new owners.

Buyer agrees to pay all applicable fees as they arise. You will be charged at the time of purchase and your subscription will automatically renew until cancelled. If you cancel a monthly payment, such cancellation will take effect in the next billing cycle. This means that we will not be able to refund you for early termination.

If you have any questions about our charges, please contact us immediately. If Hatul Madan and the customer agree that a refund should be issued, it will be processed within the next 30 days. However, the amount charged by the payment system is non-refundable. All refunds from Hatul Madan are subject to a deduction of 3% or the actual payment processing fee charged by the payment system (whichever is greater).

Please note that if you made a payment without a specific purpose, Hatul Madan has the right to independently use such funds for the needs of Hatul Madan.

1. Hyperlinking to Our Content

The following organizations may link to our website without a prior written approval:

• Online directory distributors (in the same manner as they hyperlink to the websites of other listed businesses).

1. Security

Controls for the Protection of Personal Data. Hatul Madan shall maintain administrative, physical, and technical safeguards designed for protection of the security (including protection against unlawful or unauthorized processing and against accidental or unlawful destruction, loss or alteration or damage, unauthorized disclosure of, or access to, Customer data), confidentiality, and integrity of Customer data (including personal information).

Hatul Madan has robust incident response management and data breach response policy in place. Also, we adhere to the procedures in case of any data breach and shall notify Customer without undue delay upon becoming aware of the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to Customer data, including personal information, transmitted, stored or otherwise processed by Hatul Madan or its sub-processors of which Hatul Madan becomes aware (a “Customer Data Incident”) within 72 hours of confirmation of the incident via email and/or phone.

1. Return and deletion of customer data

Hatul Madan shall return Customer data to the Customer and, to the extent allowed by the applicable law, delete Customer data in accordance with the procedures and timeframes specified in the Terms of Use.

If an account deletion request is raised from the Platform, the team will get in touch with you regarding the same within 7-10 days to seek confirmation and clarification on the request. Following the communication, the account will be deleted, and you will not be able to restore the data.

1. Disclaimer

To the maximum extent permitted by the applicable law, we exclude all representations, warranties, and conditions relating to our website and the use thereof. Nothing in this disclaimer shall:

• limit or exclude our or your liability for death or personal injury;
• limit or exclude our or your liability for fraud or fraudulent misrepresentation;
• limit any of our or your liabilities in any way that is not permitted under the applicable law; or
• exclude any of our or your liabilities that may not be excluded under the applicable law.
